Bank of Erath's Privacy Notice

Our Privacy Commitment to You. Keeping customer information secure is a top priority for all of us as the Bank of Erath (the "bank" or "we").  We are sending this privacy notice to explain how we handle the personal information about you that we collect and may disclose. The notice will apply to former customers as well as current customers unless we state otherwise.  In this notice, we refer to our "affiliates".  When we do, we mean we refer to "non-affiliated third parties", and we mean companies that are not part of the Bank’s family of companies.  This notice applies to each of the affiliate companies, which provide financial products and services to individuals primarily for personal, family or household purposes.  In this notice, we also refer to "nonpublic personal information". Generally this indicates information which you provide to us to obtain a financial product or service. 
 
Confidentiality and Security of Nonpublic Personal Information.  We protect nonpublic personal information we collect about you by maintaining physical, electronic, and procedural safeguards that comply with federal standards.  We train the people who work for us how to properly handle your nonpublic personal information. We restrict access to nonpublic information about you to persons who need to know that information to provide products and services to you. 
 
Nonpublic Personal Information We Collect. We collect nonpublic information about you from the following sources:

  • Information we receive form you on applications or other forms
  • Information about your transactions with us, our affiliates, or others
  • Information we receive from a consumer reporting agency

Nonpublic Personal Information We Disclose.  We may disclose the following kinds of nonpublic personal information about you:

  • Information we receive form you on applications or other forms, such as your name, address, or telephone number.
  • Information we receive from a consumer reporting agency, such as your creditworthiness and credit history.

Parties to Whom We May Disclose Nonpublic Personal Information.  We reserve the right to disclose nonpublic personal information about you to the following types of third parties:

  • Financial service providers, such as credit card issuers, securities brokers-dealers, and insurance producers.
  • Non-financial companies such as data processors, and check printers and others with which we have contracted to perform operational functions on behalf of the bank and our customers. 
  • Companies which perform marketing services on our behalf or to other financial service providers with which we have joint marketing agreements.

We may also disclose nonpublic personal information about you to nonaffiliated third parties as permitted by law.
 
Future Disclosure of Nonpublic Personal Information. The bank of Erath may disclose, and reserves the right to disclose nonpublic personal information it collects to certain third persons or entities.
 
We may also disclose nonpublic personal information about you to nonaffiliated third parties as permitted by law.
 
Joint Marketing/Service Provider Disclosure.  We may disclose the following information to companies that perform marketing services on our behalf or to other financial institutions with whom we have joint marketing agreements:

  • Information we receive from you on applications or other forms, such as your name, address, telephone numbers.
  • Information we receive from a consumer reporting agency, such as your creditworthiness and credit history.

Fair Credit Reporting Act Information Sharing Opt. Out.  Under the Fair Credit Reporting Act, we have the right to share information regarding our transactions and experiences with you.  Unless you instruct us otherwise, we also have the right to share any other information about you with our affiliates (persons related by common ownership or affiliated by corporate control, now or in the future) either directly or indirectly.  The other information may include, but is not limited to, application information credit reports from a consumer reporting agency, and any other information we have about you.  If you do not want us to share this other information with our affiliates you may utilize the opt out methods set forth below. 

Opt Out Information

Financial Products or Services to Which Your Opt Out Applies.  If you elect to opt out of information sharing we will treat the opt out as applying to all financial products and services that you have obtained from us in the past. 
 
Your Right to Opt Out of Information Sharing.  If you prefer that we not disclose nonpublic personal information about you or information not solely related to transactions or experiences with you to our affiliated companies or nonaffiliated third parties, you may opt out of those disclosures, that is you may direct us not to make those disclosures (other than disclosures permitted by law). 
 
We will treat an opt out direction by any joint account holder as applying to all parties on the account.
 
You may notify us of your intent to opt out of affiliate and nonaffiliate sharing by using one of the following methods.
 
How to Opt Out of Information Sharing.  To opt out of sharing information with nonaffiliated third parties, please complete and return the Notice of Intent to Opt Out – Nonaffiliated Third Parties to the following address: Bank of Erath, Post Office Drawer B, Erath, LA 70533. To opt out of sharing Information with our affiliated companies, please complete the Notice of Intent to Opt Out – Affiliates Sharing to the following address: Bank of Erath, Post Office Drawer B, Erath, LA 70533.
 
If we do not receive notice of intent to opt out of information sharing with our affiliated third parties, within 30 days of delivery of this notice to you, we are authorized to disclose information about you to our affiliated companies or to nonaffiliated third parties, in accordance with our privacy policies and practices. 
 
Notify Us of Inaccurate Information We Report To Consumer Reporting Agencies.  Please notify us if we report any inaccurate information about your account(s) to a consumer reporting agency.
